DESCRIPTION:\nDear Colleagues,\n \nI will be speaking at the November 10, 2015 dinner meeting of Desert Estate Planning Council. If you have not done so already, please make your reservation today.   The topic is "Donative Transfers and the Presumption of Undue Influence Under Probate Code sec. 21380" following the recently reported case from the Court of Appeal: Jenkins v. Teegarden (2014) 230 CA4th 1128.  Harry Wallace and I were co-counsel for the trial and appeal.  Below is a link to the case.  It gives a definition of "donative transfer" and an excellent history of PC 21350 and how it evolved to the current law under PC 21380.  If you have time, please read the case before the dinner meeting.\n \nAlso, on a personal note, I recently returned from Nepal where I completed a long-planned trek to Everest Base Camp.  I combined my mountaineering trip with a humanitarian aid mission and delivered first aid, tents, work gloves, and water purification systems following the earthquake.  If you have a few minutes, below is a link, in three parts, of an article about my trip to Nepal that ran in the Daily Pilot newspaper (for Newport Beach and Costa Mesa.)  I hope you enjoy reading the article.\n \n   Link to Jenkins v.
